A Public Notice for the Purposes of Section 121 of the Charities Act 2011

Canal & River Trust acting as Trustee of The Waterways Infrastructure Trust (charity registration number 1146792-2) (the Charity) gives notice that the Charity proposes to make the following disposals of interests in land vested in them to Leeds City Council (the Council).

The locations of each of the proposed disposals detailed below are shown on the respective plans annexed to this notice.

1. A Lease:

A. of land covered by water, comprising part of the bed of the Aire & Calder Navigation and/or the River Aire (together the Navigation) at c to the east of Thwaite Lane, Leeds LS10 1RN within the area shown edged RED on Plan LFAS-AC-P1 to this Notice to enable the Council to install, retain, maintain and replace a new movable weir in place of the previous Knostrop weir;

B. of land shown edged DARK GREEN on Plan LFAS-AC-P1 to this Notice to enable the Council to install and maintain ancillary apparatus for that weir (including an operating booth);

C. of land to the east of Thwaite Lane, Leeds LS10 1RN, comprising the landing locations of the bridges referred to in paragraph 1D below and being (a) an area of land on the north bank of the Navigation (b) the north-western end of the former "Knostrop Island" lying within the Navigation and (c) an area of land on the south side of the Navigation all of which areas of land are shown edged RED on Plan LFAS-AC-P4 to this Notice;

D. which includes rights to enable the Council to install a new footbridge above the new movable weir at Knostrop referred to in 1A above, and to modify two existing bridges over the Navigation, (which are shown coloured GREEN on Plan LFAS-AC-P4 to this Notice) and thereafter to retain those bridges (as the route of the "Trans-Pennine Trail" long-distance path and cycleway), and to repair and replace the same.

2. A Lease of rights for the use of a pedestrian and cycle route which crosses the Navigation by the bridge constructed above the new moveable weir at Knostrop, and then along the north bank of the Navigation (between Knostrop Flood Lock, to the north-east of Old Mill Lane, Leeds) before crossing the Navigation via the land referred to in 1C and the two modified existing bridges referred to in 1D above. The pedestrian and cycle route is shown coloured RED on Plan LFAS-AC-P3 to this Notice. This Lease of rights will include an obligation on the part of the Charity to dedicate that pedestrian and cycle route as restricted public highway if required by the Council.

3. A Lease of land covered by water, comprising part of the bed of the Navigation at Crown Point weir to the south of Crown Point Road, Leeds LS10 1RN within the area edged RED on Plan LFAS-AC-P2 to this Notice, to enable the Council to install, retain, maintain and replace a new movable weir in place of the previous Crown Point weir.

The proposed disposals detailed above involve, or include, property owned by the Charity.

The proposed deed of easement will grant the Council the right to construct and maintain the new bridge over the Canal. No part of the bridge is to be lower than three metres above the normal water level of the Canal. The bridge will not obstruct any part of the canal or towpath.
