Note: these Terms & Conditions were updated on 09 August 2024 to amend eligibility criteria and allow the inclusion of further participants.

1. The Promoter

The promoter is Canal & River Trust (the “Trust”), a charitable company limited by guarantee registered in England & Wales under the company number 7807276 and the registered charity number 1146792, whose Head Office is at National Waterways Museum Ellesmere Port, South Pier Road, Ellesmere Port, Cheshire, CH65 4FW (please do not send entries to this address, they will not be accepted as an entry).

2. The competition and how to enter

2.1 The title of the competition is T-Shirt Design Competition.

2.2 To enter the competition, submit a design suitable for use by the Trust on t-shirts and other merchandise via the Trust’s pinned Facebook post using the hashtag #CanalRiverTrustTeemillComp. Each design submitted:

(a) must be inspired by the Trust’s 2,000 miles of canals, rivers and reservoirs;

(b) must be the original work of the person submitting the design;

(c) must not be automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications); and

(d) can be in any art medium, provided the design must be submitted digitally at a high resolution that is capable of reproduction and formatted as follows: (i) PNG Format; (ii) 200dpi; (iii) transparent background; and (iv) fine detail – all line-work or text is wider than 2mm.

2.3 The competition will start on 1 August 2024 and continue until 31 August 2024 (the "Closing Date"). All competition entries submitted in accordance with condition 2.2 must be received by no later than 23:59 on the Closing Date. All competition entries that are not submitted in accordance with condition 2.2 and/or are received by the Trust after 23:59 on the Closing Date will be automatically disqualified.

2.4 The Trust will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind;

or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

2.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

2.7 The competition entries will be shortlisted by a panel appointed by the Trust and then judged by a public vote arranged by the Trust. The best three entries will be chosen via the public vote and ranked first, second and third. The decisions of the shortlisting panel and the public vote will be final.

2.8 The Trust will send the full names of the shortlisting panel to anyone who contacts the Trust within one month after the Closing Date of the competition requesting such details.

3. Eligibility

3.1 The competition is open to all residents in England and Wales aged 18 or over, except:

(a) employees or volunteers of the Trust or any of its group companies;

(b) employees of agents or suppliers of the Trust or any of its group companies, who are professionally connected with the competition or its administration; or

3.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Trust may require you to provide proof that you are eligible to enter the competition.

3.3 The Trust will not accept competition entries that:

(a) contain any offensive, defamatory, illegal, malicious, indecent or other inappropriate content;

(b) have been submitted previously in any promotion or giveaway of any kind or shared publicly through any means;

(c) refer to brands or promote businesses other than those of the Trust;

(d) bring the Trust or any other party into disrepute or would damage their reputation;

(e) include trademarks, logos, copyright, designs or any other third party owned materials or intellectual property which the entrant does not have the express permission to use; or

(f) include names or identifiable information of any individual without their express permission.

3.4 The Trust reserves the right to exclude any entry at any time and in its absolute discretion if it has reason to believe that a participant has breached these terms and conditions.

3.5 There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4. The prizes and winners

4.1 The prizes are:

(a) first prize: a t-shirt displaying the winning participant’s design;

(b) second prize: a tote bag displaying the second-placed participant’s design; and

(c) third prize: a mug displaying the third-placed participant’s design.

4.2 The Trust reserves the right to replace any of the prizes with an alternative prize of equal or higher value if circumstances beyond the Trust's control makes it necessary to do so. The prizes are not negotiable or transferable.

4.3 The decisions of the shortlisting panel and the public vote arranged by the Trust will be final and no correspondence or discussion will be entered into.

4.4 The Trust will contact the winners personally as soon as practicable after 20 September 2024 (the “Announcement Date”) via direct message on Facebook. The winners will then have 21 days to respond to the Trust’s message within which they must notify the Trust of their address for delivery of the applicable prize and such other information as the Trust may reasonably require. Delivery addresses must be within the UK.

4.5 In the event that a participant fails to provide the Trust with such information as required by condition 4.4 within 21 days, the Trust reserves the right to offer the prize to an alternative entrant selected in accordance with condition 2 above from the valid entries that were received before the Closing Date.

4.6 The Trust is not responsible for any goods or services supplied under these terms and conditions or as part of the competition.

4.7 The Trust must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Trust will send the surname and county of prize winners and, if applicable copies of their winning entries, to anyone who requests such details by contacting the Trust at [email protected] within one month after the Announcement Date.

4.8 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Trust at [email protected]. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

4.9 Participants accept that, if their entry wins a prize, they will agree to be interviewed by the Trust without additional payment or permission following the Announcement Date for the purposes of announcing the successful applicants of the competition and for related publicity purposes. Such interviews may be published on the Trust’s website and/or social media accounts.

5. Ownership of competition entries and intellectual property rights

5.1 All competition entries and any accompanying material submitted to the Trust will become the property of the Trust on receipt and will not be returned. You must ensure that your submitted entry does not infringe the intellectual property rights of any third party.

5.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign absolutely to the Trust all your intellectual property rights held in the competition entry with full title guarantee; and

(b) waive absolutely all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

6. Data protection and publicity

6.1 Any personal data received as part of the competition will be processed in accordance with the Data Protection Legislation and the Trust’s Privacy Notice and the applicable Privacy Schedule. By entering the competition, you agree that any personal data provided with your entry may be held and used only by the Trust or its agents or suppliers to administer the competition. In particular, the Trust will need to share the personal details of prize winners with its supplier, Teemill, in order to distribute prizes. See also conditions 4.7 to 4.9 regarding the announcement of winners and publicity.

6.2 Participants have the right to request access, erase, rectify, object, and restrict the processing of their personal data. To exercise any of these rights please email [email protected].

7. General

7.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Trust may, at its sole discretion, reserve the right to exclude you from participating in the competition.

7.2 The Trust reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

7.3 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in England and Wales.
